1.1 Legal Framework: Accessing or using the Service forms a legally binding contract governed by these Terms and our integrated Privacy Policy.
1.2 Electronic Signature: Tapping interactive buttons such as "CONTINUE", "PAY", or "REGISTER" constitutes a valid digital signature and acceptance of electronic communications.
1.3 Age Limit: Users must be 18 years of age or older. Accessing the app warrants full legal capacity to enter into these Terms.
2.1 Consent-Based Safety Tool: The Service provides live location monitoring, arrival/departure alerts, device battery monitoring, and emergency SOS signals for family use. Tracking requires prior explicit consent from each participant.
2.2 Emergency Services Disclaimer: The Service is not a substitute for emergency, professional security, or law enforcement systems. Location readings rely on GPS/network estimates and should not be relied upon in life-critical situations.
2.3 Jurisdiction & Trade Restrictions: The Service is unavailable where prohibited by law.
2.4 Excluded Regions & Entities: Access is strictly barred for individuals and entities from: Belarus, Russian Federation, occupied regions of Ukraine (including Crimea), Cuba, Iran, North Korea (DPRK), Sudan, Syria, and Venezuela. We reserve the right to immediately terminate access without refund for anyone paying taxes to or supporting aggression against Ukraine.
3.1 Hardware & Network Charges: Users are responsible for providing compatible devices, operating systems, and internet connections, including all third-party data fees.
3.2 App Changes & Discontinuance: Features may be added, altered, or removed (free or paid) without notice or liability.
3.3 Content Backups: Routine backups are performed, but we assume no liability for data corruption, loss, or recovery failures.
3.4 Account Suspension: Accounts may be suspended or terminated immediately for breaching these Terms.
4.1 Auto-Renewal Terms: Subscriptions automatically renew for identical successive periods unless canceled at least 24 hours prior to the end of the current billing cycle. Fees are processed through the Apple App Store.
4.2 Discount Reversion: Promotional rates apply only to the initial specified period; normal full pricing resumes automatically upon renewal.
4.3 Price Adjustments: Fee changes will be communicated in advance, giving you time to cancel before new rates take effect.
4.4 iOS Cancellation Procedure:
5.1 Proprietary Ownership: All software, design assets, text, graphics, and trademarks are owned by ONSOFFOUR OÜ or its licensors and are protected under international IP laws.
5.2 License Grant: Users receive a non-transferable, non-exclusive, revocable license for personal, non-commercial app usage.
5.3 IP Restrictions: Reverse engineering, decompiling, adapting, translating, or selling any part of the Service is prohibited.
6.1 User Content License: You retain ownership of content submitted to the platform. However, you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, adapt, and display User Content to run and market the Service. Personal data is excluded from this license.
6.2 App Store Beneficiary: The Apple App Store is recognized as a third-party beneficiary entitled to enforce these Terms.
6.3 External Content & Interactions: We assume no responsibility for third-party links, integrated platforms, or interactions between individual users.
7.1 Statutory Warranties: You confirm that you are not listed on US/EU/UK sanctions lists, nor located in a US-embargoed or "terrorist supporting" region.
7.2 Prohibited Behaviors: Users must not bypass paywalls, distribute malicious code, scrape app data, or use the Service for unlawful surveillance.
7.3 Support Abuse Policy: Hostile, abusive, or harassing behavior toward customer support personnel will result in immediate account termination.
8.1 Indemnification: You agree to defend and hold harmless ONSOFFOUR OÜ against any claims, losses, or legal expenses resulting from your app use, User Content, or breach of these Terms.
8.2 Warranty Disclaimer: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including fitness for a particular purpose or error-free operation.
8.3 Maximum Aggregate Liability:
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE IS STRICTLY LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE THREE (3) CALENDAR MONTHS PRECEDING THE CLAIM.
8.4 California Waiver: California residents explicitly waive California Civil Code Section 1542.
9.1 Governing Law: Laws of the Republic of Estonia apply (excluding CISG, UCC, and UCITA frameworks).
9.2 Negotiation & Venue: Disputes are subject to 30 days of mandatory good-faith negotiation prior to initiating proceedings in the Courts of Estonia.
9.3 Agreement Termination: Users may terminate by canceling subscriptions, deleting their account, and removing the app. We reserve the right to cancel service without cause, providing a prorated refund for remaining prepaid days.
